General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

These GTC also apply to future business relationships with entrepreneurs without the need to reference them again. If an entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected. They will only become part of the contract if we expressly agree to them.

2. Contractual Partner and Conclusion of Contract

The purchase contract is concluded with Leuchtenland.com GmbH.

The presentation of products in the online shop does not constitute a legally binding offer but serves as a non-binding online catalogue. You can add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided during the order process. By clicking the order button, you place a binding order for the items in your shopping cart. Confirmation of receipt of your order will be sent to you via email immediately after the order is submitted.

The timing of the contract conclusion depends on the payment method you select:

Prepayment
We accept your order by sending a separate email within two days containing our bank details.

Credit Card
We accept your order by sending a separate email confirmation or by delivering the goods within two days.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal, where you can enter your payment details and confirm the payment instruction. After placing your order, we will request PayPal to initiate the payment transaction, thereby accepting your offer.

Amazon Pay
During the order process, you will be redirected to the website of Amazon. There, you can select the delivery address and payment method stored with Amazon and confirm the payment. After placing your order, we will request Amazon to initiate the payment transaction, thereby accepting your offer.

Cash on Collection
We accept your order by sending a separate email confirmation within two days.

3. Contract Language and Storage

The language available for the conclusion of the contract is German.

We store the contract text and send you the order details and our GTC by email. You can view the contract text in your customer account.

4. Delivery Terms

Shipping costs may be incurred in addition to the stated product prices. Details about shipping costs can be found in the product offers and at Shipping & Delivery.

During the order process, you can select your preferred shipping provider. However, we reserve the right to switch to a different shipping partner if economic reasons, product sensitivity, or the size/number of parcels make this reasonable.

If a shipment is refused or cannot be delivered due to an incorrect delivery address provided during the order process, we may charge the customer for the shipping costs of a new delivery.

You may also collect your goods from Leuchtenland.com GmbH, Wierlings Hook 4, 48249 Dülmen, Germany, during the following business hours: 8:00 am – 4:30 pm.

We also deliver to Deutsche Post packing stations and branches (within Germany only).

5. Payment

The following payment methods are available:

Prepayment
We will send you our bank details in a separate email, and the goods will be delivered after receipt of payment.

Credit Card
By submitting your order, you provide your credit card details. After verifying your authorization as the cardholder, the payment transaction will be initiated automatically by the credit card company.

PayPal
You will be redirected to PayPal during the order process. You must be registered with PayPal or register to complete the payment. After placing your order, we will request PayPal to initiate and process the payment transaction.

Amazon Pay
During the order process, you will be redirected to Amazon. You must be registered with Amazon to complete the order. After selecting your preferred delivery address and payment method, you will finalize the transaction, and we will request Amazon to process the payment.

Ratepay
If you have selected the payment method of our payment partner Ratepay, payments with debt discharging effect can only be made to Ratepay. Further details can be found in the Ratepay Terms of Payment and in the Ratepay Data Privacy Statement.

Cash on Collection
Payment is made in cash when collecting the goods.

6. Retention of Title

The goods remain our property until full payment is received.

For entrepreneurs, the following additional terms apply: We retain title to the goods until all claims arising from the ongoing business relationship are settled. The entrepreneur may resell the goods in the ordinary course of business. Claims arising from such resale are assigned to us in advance, up to the amount of the invoice value.

7. Transport Damage

The following applies to consumers:

If goods are delivered with obvious transport damage, please report this to the delivery agent immediately and contact us as soon as possible. Failure to report does not affect your statutory warranty rights but helps us assert claims against the carrier or transport insurance.

The following applies to entrepreneurs:

The risk of accidental loss or deterioration transfers to the buyer as soon as we have delivered the item to the forwarding agent, the carrier or the person or institution otherwise designated to carry out the shipment. The obligation to inspect and give notice of defects regulated in § 377 HGB applies to entrepreneurs. Failure to notify us will result in the goods being deemed accepted unless the defect was not recognisable during the inspection. This shall not apply if we have fraudulently concealed a defect.

8. Exclusion of Exchange for Custom-Ordered Spare Parts

Spare parts that are not part of our regular product range and are specially ordered at the explicit request of the customer are excluded from exchange. This also applies if the spare part is not kept in stock for immediate resale.

9. Warranty and Guarantees

Unless otherwise stated, statutory liability for defects applies.

The following applies to the purchase of used goods by consumers: If the defect occurs after the expiry of one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.

For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. The sale of used goods is subject to the exclusion of any warranty. The statutory limitation periods for the right of recourse according to § 445a BGB remain unaffected.

In relation to entrepreneurs, only our own information and the manufacturer's product descriptions included in the contract shall be deemed to be an agreement on the quality of the goods; we accept no liability for public statements made by the manufacturer or other advertising statements.

If the delivered item is defective, we shall initially provide warranty to entrepreneurs at our discretion either by rectifying the defect (subsequent improvement) or by delivering a defect-free item (replacement delivery).

The above restrictions and shortened deadlines do not apply to claims based on damage caused by us, our legal representatives, or vicarious agents:

  • in the event of injury to life, body, or health
  • in the event of intentional or gross negligence and fraudulent intent
  • in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the scope of a guarantee promise, if agreed
  • insofar as the scope of application of the Product Liability Act is opened.

Additional guarantee conditions, if applicable, are detailed with the product and on specific information pages in the shop.

10. Liability

We are fully liable for claims based on damage caused by us, our legal representatives, or vicarious agents:

  • in the event of injury to life, body, or health,
  • in the event of wilful or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened up.

In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

11. Participation in Sweepstakes

Leuchtenland.com GmbH occasionally hosts sweepstakes, particularly via its official social media channels (e.g. Facebook, Instagram). Specific terms and conditions apply to each sweepstake and will be clearly communicated in the context of the promotion—for example, in the associated social media post or on a dedicated landing page.

These sweepstake terms outline the requirements for participation, the entry period, the method of winner selection, and relevant information regarding data processing. In the event of a conflict, these terms take precedence over the general terms and conditions.

Please note that these sweepstakes are in no way affiliated with, sponsored by, organized by, or supported by Facebook, Instagram, or any other platform provider. All information submitted by participants is received solely by Leuchtenland.com GmbH.

Unless otherwise stated, legal recourse is excluded for all sweepstakes.

12. Notice in accordance with the Battery Law Implementation Act (BattDG)

As some of the products distributed by Leuchtenland.com GmbH may contain batteries or rechargeable batteries (accumulators), we are legally obliged under the German Battery Law Implementation Act (BattDG) to inform our customers of the following: Batteries and rechargeable batteries must not be disposed of with household waste. Customers are legally required to return used batteries and rechargeable batteries to ensure they are properly recycled or disposed of in an environmentally sound manner.

Used batteries may contain harmful substances that, if not stored or disposed of correctly, can pose risks to human health or the environment. At the same time, batteries contain valuable materials such as iron, zinc, manganese, and nickel that can be recovered and reused. Customers may return used batteries either by sending them back to Leuchtenland.com GmbH or by dropping them off—free of charge—at nearby collection points (e.g. in retail stores or municipal recycling centres). Returns at retail outlets are limited to household quantities and to those battery types that the retailer currently sells or has previously sold as new batteries.

Batteries and accumulators intended for separate collection and not for disposal in household waste are marked with the symbol of a crossed-out wheeled bin. Below this symbol, one or more of the following chemical symbols may appear, indicating the presence of specific substances:

Pb: Battery contains lead.
Cd: Battery contains cadmium.
Hg: Battery contains mercury.

13. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which is available at: https://ec.europa.eu/consumers/odr/. Consumers can use this platform to resolve disputes.

To settle disputes arising from a contractual relationship with a consumer, or to determine whether such a contractual relationship exists, we are required to participate in dispute resolution proceedings before a universal arbitration board. The responsible body is: Universalschlichtungsstelle des Zentrums für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in dispute resolution proceedings before this body.

14. Final Provisions

If you are an entrepreneur, German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant under the German Commercial Code, a legal entity under public law, or a public-law special fund, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our registered office.
